1. Who we are
NYC Buy Sell Trade ("the Platform", "we", "us") is an online marketplace that connects members of the NYC buy/sell/trade community. By creating an account or using any part of the site you agree to these Terms.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts. You agree to provide accurate information and keep your account secure.
3. Listings and prohibited items
Sellers are responsible for the accuracy of every listing, including photos, condition, size, and shipping information. You may not list weapons, controlled substances, counterfeit goods, stolen property, live animals, hazardous materials, or anything illegal under federal, New York State, or NYC law.
4. Buying and selling
All paid transactions are processed through Stripe. Funds are held in escrow after checkout and released to the seller once the buyer confirms receipt or the confirmation window ends. Buyers agree to inspect items promptly and either confirm the order or open a dispute within the window shown on the order page.
5. Fees
A 3% service fee is added to the buyer's total at checkout. Card processing fees are deducted from the seller's payout. Additional fees may apply to promoted listings or advertising placements and are shown before purchase.
6. Shipping
Sellers must ship within the timeframe advertised, upload a valid tracking number before marking the order as shipped, and package items appropriately. Local pickup is not supported.
7. Disputes and refunds
Buyer and seller protection is described in our Refund & Dispute Policy. Our team reviews escalated disputes and may release, refund, or split funds based on the evidence provided.
8. Conduct
No harassment, hate speech, spam, scams, off-platform payment requests, or attempts to circumvent our fees. We may remove listings, suspend accounts, or refund transactions at our discretion.
9. Content you post
You keep ownership of the photos and text you upload. You grant us a non-exclusive license to display and distribute that content on the Platform and in marketing of the Platform itself.
10. Termination
You can delete your account at any time. We can suspend or terminate accounts that violate these Terms.
11. Disclaimers
The Platform is provided "as is." We do not guarantee uninterrupted service or the accuracy of user-posted content. To the maximum extent allowed by law, we are not liable for indirect or consequential damages arising from your use of the Platform.
12. Changes
We may update these Terms. Material changes will be posted here with a new "Last updated" date. Continued use after changes means you accept them.
